By accessing or using SMB Sidekick ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including business owners, their employees, and anyone acting on their behalf.
SMB Sidekick provides AI-powered voice and SMS agent services for small businesses. The Service includes a dedicated phone number, AI call answering, SMS response automation, call summary delivery, and a customer dashboard. Features are subject to change with reasonable notice.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old and a legal business owner or authorized representative to use the Service.
Subscription fees are billed monthly or annually in advance. A 14-day free trial is available for new accounts; no credit card is required during the trial. After the trial, continued use requires a valid payment method. All payments are processed by Stripe. Overage charges apply when usage exceeds plan limits ($0.09/minute for Starter, $0.07 for Growth, $0.05 for Pro). We do not store payment card data — all billing is handled by Stripe.
You may cancel your subscription at any time from the Billing page in your dashboard. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused days. Your data is retained for 30 days after cancellation, after which it is permanently deleted.
You are responsible for ensuring your use of the Service complies with the Telephone Consumer Protection Act (TCPA), applicable FCC regulations, and state wiretapping laws. Every AI-handled call includes the required AI disclosure and recording notice. You may not use the Service to send unsolicited commercial messages, engage in robocalling, or violate any applicable communications law. Opt-out requests from your callers must be honored within 10 business days per 2025 FCC rules. We maintain audit logs of all AI-disclosed calls. Message and data rates may apply to SMS messages sent through the Service. Message frequency varies based on caller requests and business owner settings. Reply HELP for help or STOP to cancel. We do not store raw call recordings or verbatim transcripts. Call data is stored as AI-generated summaries only. All call summaries are automatically deleted after 3 years. SMS logs are deleted after 12 months. Consent records are retained for 4 years as required by law. By using the Service, you agree to our Privacy Policy, which is incorporated by reference into these Terms.
You may not use the Service for any unlawful purpose, to transmit spam or unsolicited communications, to impersonate any person or entity, to interfere with or disrupt the Service, or to attempt to gain unauthorized access to any system or network. We reserve the right to suspend or terminate accounts that violate these terms without notice.
We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Twilio, Vapi, Supabase), or force majeure events may cause temporary unavailability. We are not liable for losses resulting from service interruptions outside our reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMB SIDEKICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages, so these limitations may not apply to you.
We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
